Prop Rental Terms and Conditions

1. Definitions

a. "Owner" refers to This & That Props Inc.
b. "Renter" refers to the individual, company, or entity renting the props from the Owner.
c. "Props" refers to the items being rented, including any associated accessories or equipment


2. Rental Agreement

a. By renting the Props from the Owner, the Renter agrees to be bound by these Terms and Conditions.
b. The rental period begins on the agreed-upon start date and ends on the agreed-upon return date.
c. Security deposits may be required prior to pickup.


3. Rental Fee and Payment

a. The Renter agrees to pay the specified rental fee for the Props.
b. The rental fee covers the rental period and does not include additional costs such as taxes or damages.
c. Any quote provided is an estimate only and may not reflect the final price on the invoice.
d. Payment is due within thirty (30) days of receipt of the invoice. Late payments may incur interest at a rate of five percent (5%) per month.
e. Accepted payment methods include e-transfer, cheque, debit, and credit cards. Debit and credit card payments will incur a 3.5% processing fee based on the final invoice amount.
f. A minimum of twenty-four (24) hours’ notice is required for all orders. Orders placed with less notice may be subject to additional fees.
g. Hold fees may apply for orders pulled more than one (1) week prior to the scheduled pickup date.
h. Late fees may apply for Props not returned within one (1) week of the agreed-upon return date.


4. Use of Props

a. The Renter shall use the Props solely for the agreed-upon purpose and in a professional and responsible manner.
b. The Renter shall not alter, modify, or adapt the Props without prior written consent from the Owner.
c. The Renter is responsible for ensuring that all individuals using the Props are properly trained and qualified.


5. Filming, Photography, and Usage Rights

a. The Owner makes no representations or warranties as to whether any Props may be filmed, photographed, videotaped, recorded, displayed, or otherwise utilized without the consent of third parties.
b. The Renter acknowledges and agrees that it is solely responsible for determining whether any permissions, licenses, clearances, or consents are required for the intended use of the Props.
c. The Renter shall be solely responsible for obtaining and paying for any required permissions, licenses, clearances, or consents.
d. The Owner shall not be liable for any claims, damages, losses, costs, or expenses arising from the Renter’s failure to obtain such permissions or consents.


6. Care and Maintenance

a. The Renter shall exercise reasonable care and take all necessary precautions to prevent damage, loss, or theft of the Props during the rental period.
b. The Renter shall promptly notify the Owner of any damage, malfunction, or issue affecting the Props.
c. The Renter shall not attempt to repair or modify the Props without prior written consent from the Owner.


7. Liability and Insurance

a. The Renter assumes full responsibility and liability for any injury, damage, or loss arising from the use or misuse of the Props during the rental period.
b. The Renter shall obtain and maintain adequate insurance coverage to protect against any liability, damage, or loss incurred during the rental period.
c. The Owner shall not be held liable for any damages, injuries, or losses arising from the use of the Props.


8. Return of Props

a. The Renter shall return the Props in the same condition as received, normal wear and tear excepted.
b. Props must be returned by the agreed-upon return date, at the specified location, unless otherwise agreed to in writing.
c. Late returns may result in additional fees or charges.


9. Termination

a. Termination of this agreement does not relieve the Renter of responsibility for payment of any outstanding fees, damages, or losses.


10. Governing Law

a. This agreement shall be governed by and interpreted in accordance with the laws of Ontario, Canada.
b. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Ontario.


11. Entire Agreement

a. These Terms and Conditions constitute the entire agreement between the Owner and the Renter and supersede all prior agreements or understandings, whether written or oral.
